PLEASE READ THESE TERMS OF USE ("TERMS") CAREFULLY; THEY CONSTITUTE A LEGAL CONTRACT BETWEEN YOU, THE USER (AS DEFINED BELOW), AND MASTAPREP. These Terms govern your use, and our provision to you, of any MastaPrep product or service that contains a link to these Terms, including https://mastaprep.com and its subdomains and any other website operated by or on behalf of MastaPrep with a link to these Terms (collectively, the "Site"), and any content, information, services, features, or resources available or enabled on the Site (collectively, the "Services"). Any visitor to the Site or user of any other part of the Services is referred to herein as "User", "you", or "your".
MastaPrep is operated by Aakash Sureka, an individual in India trading as MastaPrep. Support and legal correspondence: support@mastaprep.com. Our Contact page explains how to raise a complaint.
Your use of the Services may be subject to any additional terms, conditions, and policies that we separately post on the Services — including our Privacy Policy, Refund and Cancellation Policy, Digital Delivery Policy and Community Guidelines — which are incorporated by reference into these Terms (the "Supplemental Terms," together with the Terms, the "Agreement"). If there is any conflict between these Terms and any Supplemental Terms, the Supplemental Terms will control to the extent of the conflict and only with respect to the Services or features subject to the Supplemental Terms.
BY PURCHASING A SUBSCRIPTION, OR OTHERWISE ACCESSING OR USING THE SERVICES, OR ANY PORTION THEREOF, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE AGREEMENT. YOU FURTHER REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THE AGREEMENT. IF YOU ARE A USER UNDER THE AGE OF EIGHTEEN (18) YEARS OLD, YOU AGREE THAT YOU HAVE REVIEWED THESE TERMS WITH YOUR PARENT OR LEGAL GUARDIAN AND THAT HE OR SHE AGREES TO THESE TERMS ON YOUR BEHALF AND TAKES FULL RESPONSIBILITY FOR YOUR COMPLIANCE WITH THESE TERMS. IF YOU DO NOT AGREE TO BE BOUND BY THE AGREEMENT, YOU MAY NOT ACCESS OR USE THE SERVICES. THE SERVICES ARE NOT INTENDED FOR USE BY INDIVIDUALS UNDER THE AGE OF FOURTEEN (14). YOU MAY NOT USE THE SERVICES OR ACCEPT THE TERMS IF YOU ARE NOT AT LEAST FOURTEEN (14) YEARS OLD.
BY STARTING A SUBSCRIPTION, YOU ACKNOWLEDGE AND AGREE THAT YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AND THAT YOU AUTHORIZE MASTAPREP (OR ITS PAYMENT PROCESSOR) TO CHARGE YOUR PAYMENT METHOD WHEN ANY FREE TRIAL ENDS AND FOR EACH RENEWAL FOR THE APPLICABLE AMOUNT UNTIL YOU CANCEL YOUR SUBSCRIPTION IN ACCORDANCE WITH SECTION 5.6.
PAID SUBSCRIPTIONS MUST BE PURCHASED BY AN ADULT WITH LEGAL CAPACITY TO ENTER THE CONTRACT. AN ADULT BUYING FOR A STUDENT ACCEPTS THE SUBSCRIPTION AND PAYMENT OBLIGATIONS IN THESE TERMS. A PAYMENT DOES NOT BY ITSELF ESTABLISH GUARDIANSHIP.
Subject to your compliance with the Agreement, MastaPrep grants you a limited non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your own personal, educational purposes.
You understand that the Services are evolving. You acknowledge and agree that MastaPrep may update the Services with or without notifying you. You may need to update third-party software from time to time in order to use or continue using the Services. Any future release, update or other addition to the Services will be subject to the Agreement. We may correct content and improve the Services; we will not use these Terms to remove the essential value of a paid period without an appropriate remedy where required.
Certain features of the Services may rely on third-party websites, services, technology, or applications accessible or otherwise connected to the Services but not provided by MastaPrep (each, a "Third-Party Service" and, collectively, "Third-Party Services"). Use of such Third-Party Services may be subject to separate terms and conditions. You are solely responsible for complying with each Third-Party Service's terms and conditions. Notwithstanding anything to the contrary in this Agreement, you acknowledge and agree that (a) MastaPrep shall not be liable for any damages, liabilities, or other harms in connection with your use of and/or any inability to access the Third-Party Services; and (b) MastaPrep shall be under no obligation to inquire into and shall not be liable for any damages, other liabilities or harm to any person or entity relating to any losses, delays, failures, errors, interruptions or loss of data occurring directly or indirectly by reason of Third-Party Services or any other circumstances beyond MastaPrep's control, which may include without limitation the failure of a Third-Party Service.
By accessing and using the Services you agree that you will not, and will not permit any third party to: (a) license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Services or any portion of the Services or any content displayed thereon; (b) use any metatags or other "hidden text" using MastaPrep's name or trademarks; (c) frame or utilize framing techniques to enclose any trademark, logo, or other MastaPrep content (including images, text, page layout or form) of MastaPrep; (d) modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of the Services except to the extent the foregoing restrictions are expressly prohibited by applicable law; (e) access or use the Services in order to build a similar or competitive website, product, or service; and (f) use any manual or automated software, devices or other processes (including but not limited to spiders, robots, scrapers, crawlers, avatars, data mining tools or the like) to "scrape" or download data from any web pages or components of the Services (except that we grant the operators of public search engines revocable permission to use spiders to copy materials from web pages in the Services for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials). All copyright and other proprietary notices on the Services (or on any content displayed on the Services) must be retained on all copies thereof.
You acknowledge and agree that MastaPrep will have no obligation to provide you with any support or maintenance in connection with the Services beyond what is described in Section 13 and our published policies. As between us and you, you are solely responsible for any fees, including Internet connection or mobile fees, that you incur when accessing the Services. Use a compatible browser and internet connection. Essential compatibility requirements and any material limitations will be disclosed before purchase.
MastaPrep is for students aged 14 and older. If you are under 18, you confirm that you have reviewed these Terms with your parent or legal guardian and that they agree to them on your behalf. A guardian may also record their permission through the optional guardian process in Settings. Where the law of your country requires verifiable parental consent, we will ask for it and may restrict access until it is given. We do not knowingly collect or solicit personal information from children under the age of fourteen (14). If we learn that we have collected personal information from a person under fourteen (14), or from a student under eighteen (18) without the authorisation their local law requires, we will restrict the relevant processing and arrange an appropriate response, which may include deletion. If you believe that a child has provided personal information to us without authorisation, please contact us as soon as possible at support@mastaprep.com. You can view more information about our collection, use, and disclosure of personal data in our Privacy Policy at mastaprep.com/legal/privacy.
If you provide MastaPrep with any feedback or suggestions regarding the Services ("Feedback"), you hereby assign to MastaPrep all rights in such Feedback and agree that MastaPrep shall have the right to use and fully exploit such Feedback and related information in any manner it deems appropriate. You acknowledge that MastaPrep shall have no obligation to compensate, credit, or otherwise reward you for providing such Feedback, and that MastaPrep shall own all improvements or derivative works created from or incorporating the Feedback. MastaPrep will treat any Feedback you provide to MastaPrep as non-confidential and non-proprietary. You agree that you will not submit to MastaPrep any information or ideas that you consider to be confidential or proprietary.
You acknowledge that all the intellectual property rights, including copyrights, trademarks, and trade secrets, in the Services and its content are owned by MastaPrep or MastaPrep's licensors. Neither the Agreement (nor your access to the Services) transfers to you or any third party any rights, title or interest in or to such intellectual property rights, except for the limited access rights expressly set forth in Section 1. MastaPrep and its licensors reserve all rights not granted in the Agreement. There are no implied licenses granted under the Agreement. Your subscription gives you a personal, limited right to use the included content for study during your access period. It does not transfer ownership.
"User Content" means any and all information and content that a User submits to, or uses with, the Services (e.g., information you include in your profile, answers and work you enter, content you upload into or create through use of a feature on the Services, reports, and the content of any messages you create using social or challenge features within the Services). You are solely responsible for your User Content. You assume all risks associated with use of your User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that personally identifies you or any third party. You hereby represent and warrant that your User Content does not violate Section 3. You may not represent or imply to others that your User Content is in any way provided, sponsored or endorsed by MastaPrep. MastaPrep is not obligated to backup any User Content, and your User Content may be deleted at any time without prior notice, subject to our Privacy Policy. You are solely responsible for creating and maintaining your own backup copies of your User Content if you desire.
You retain rights you have in material you submit. You grant MastaPrep a non-exclusive, royalty-free, worldwide licence to store, process, reproduce and display your User Content only as reasonably needed to provide the feature you use (including making content you choose to share available to the Users you select), handle reports and maintain the Services, subject to our Privacy Policy. This is not a licence to use a student's name, results or content in advertising without separate permission.
We reserve the right (but have no obligation) to review any User Content, and to investigate and/or take appropriate action against you in our sole discretion if you violate Section 3 or any other provision of the Agreement or otherwise create liability for us or any other person. Such action may include removing or modifying your User Content, terminating your access to the Services, and/or reporting you to law enforcement authorities. Where appropriate, we will explain the reason and provide a way to challenge the decision. Urgent security or safeguarding action may precede notice.
You agree not to: (a) use the Services to upload, transmit, display, or distribute any User Content that (i) violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; or (ii) is in violation of any law, regulation, or obligations or restrictions imposed by any third party, or is otherwise objectionable; (b) send through the Services unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (c) abuse other Users' personal information that you receive through the Services, such as to harvest, collect, gather or assemble information or data regarding other Users, including e-mail addresses, without their consent; (d) interfere with any other User's use and enjoyment of the Services; (e) impersonate any person or entity, including any employee or representative of MastaPrep; (f) harass, threaten or interfere with any other User's use and enjoyment of the Services, or expose someone else's private information; (g) interfere with security, access another person's account, manipulate rankings or leagues, or abuse payment or refund processes; or (h) use the Services to engage in, facilitate, or promote academic dishonesty, including obtaining or distributing leaked exam materials or assisting cheating in a live examination. Our Community Guidelines explain social-feature expectations and reporting. Any violation of this acceptable use policy will result in MastaPrep's right to immediately terminate your access and rights to use the Services. Any refund consequences will be assessed fairly and subject to applicable law; suspension does not automatically forfeit every consumer right.
In order to access and use certain features of the Services, you may need to register or create an account on the Services ("Account") and provide certain information about yourself as prompted by the account registration form, including the age and authorisation steps we request. You agree to provide information required for your use of the Services that is true, accurate, current and complete, and to update such information so it remains true, accurate, current and complete. MastaPrep reserves the rights to establish eligibility criteria to use the Services, and in some cases, at our sole discretion, impose limitations or restrictions on certain Accounts including, but not limited to, deletion of Accounts.
You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. You agree to immediately notify MastaPrep of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security. You agree not to create an Account using a false identity or false information, or on behalf of someone other than yourself. Accounts are for the identified student's use; parents should use the designated parent or support process rather than share a student's password. We may take reasonable steps to verify account ownership or authority before disclosing information or making sensitive changes. MastaPrep cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
MastaPrep uses Razorpay Software Private Limited and its affiliates as its third-party service provider for payment services (e.g., card and UPI acceptance, merchant settlement, and related services) ("Third-Party Service Provider"). If you make a purchase on the Services, you will be required to provide your payment details and any additional information required to complete your order directly to our Third-Party Service Provider. You agree to be bound by Razorpay's Privacy Policy (currently accessible at https://razorpay.com/privacy/) and its Terms of Use (currently accessible at https://razorpay.com/terms/) and hereby consent and authorize MastaPrep and Razorpay to share any information and payment instructions you provide with one or more Third-Party Service Provider(s) to the minimum extent required to complete your transactions. Please note that online payment transactions may be subject to validation checks by our Third-Party Service Provider and your card issuer, and we are not responsible if your card issuer declines to authorize payment for any reason. For your protection, our Third-Party Service Provider uses various fraud prevention protocols and industry standard verification systems to reduce fraud and you authorize it to verify and authenticate your payment information. Your card issuer or bank may charge you an online handling fee, currency-conversion or cross-border charge. We are not responsible for this. We remain responsible for our Services and our customer obligations.
MastaPrep offers a free plan. THE FREE PLAN DOES NOT REQUIRE A PAYMENT CARD AND DOES NOT AUTOMATICALLY CONVERT INTO A PAID SUBSCRIPTION. Its included features are described on our Pricing page. Your Account's first Subscription starts with a free trial of three (3) days with full access (the "Free Trial"). WHEN YOU START THE FREE TRIAL YOU PROVIDE A PAYMENT METHOD, WHICH IS AUTHORISED BUT NOT CHARGED; THE FIRST SUBSCRIPTION FEE IS CHARGED AUTOMATICALLY WHEN THE FREE TRIAL ENDS UNLESS YOU CANCEL BEFORE THEN. The exact end of your Free Trial and the amount of the first charge are shown before you start, in Settings → Plan and billing, and in the confirmation email, and we send a reminder email before the Free Trial ends. You may cancel during the Free Trial at any time using the Cancel trial control in Settings → Plan and billing, through a parent payer's secure management link, or by contacting support; if you cancel, no fee is charged and your access continues to the end of the Free Trial, after which your Account returns to the free plan with your learning progress kept. The Free Trial is available once per Account across all billing periods: cancelling it, letting it run, changing plans or subscribing again does not create another Free Trial, and a later Subscription is charged from its start. A One-Time Purchase (Section 5.5) does not include a Free Trial and is charged at purchase. Some payment methods may show a small temporary authorisation hold, which is not a charge and is released by your bank.
The Services are available on a monthly (MastaPrep Plus) or annual (MastaPrep Pro) subscription basis (each, a "Subscription"). Both Subscriptions provide the same access. Access to the Services is delivered digitally and considered "used" once you log in or access any part of the paid Services. Because delivery occurs immediately, you agree that digital access constitutes receipt of goods and services, without prejudice to the Free Trial and the rights described in Section 5.9. Each Subscription provides access to the practice library, full-length practice tests, a personal study plan, progress tracking and other features as described at mastaprep.com/pricing. Features described as forthcoming, experimental or unavailable (including the Masta AI tutor add-on until it ships) are not included unless the purchase page expressly says otherwise. MastaPrep reserves the right to modify, discontinue, or change any plan at any time in its discretion, subject to Section 1.2.
The Subscription fee details are provided at mastaprep.com/pricing (the "Fee") and may be updated from time to time. Before you pay, we show the amount due, billing currency, applicable taxes, subscription period, renewal details and any Free Trial eligibility. The Fee will be billed at the start of the Subscription and thereafter at the interval you select at the time of purchase (monthly or annual). MastaPrep reserves the right to modify, discontinue, or change any plan or pricing at any time in its discretion; however, any such changes will apply prospectively and will not affect the current billing period for an active Subscription. We will notify you before a price change affects a future renewal and explain how to cancel. Where fresh consent or other notice is required, we will obtain or provide it.
Where offered, you may instead buy a plan period as a one-time card payment (a "One-Time Purchase"). A One-Time Purchase does not renew and no further amount is charged: access ends on the date shown in Settings unless you buy again, and a further purchase starts when the current period ends. A One-Time Purchase is charged at purchase and does not include the Free Trial; the remainder of this Section 5.5 applies to Subscriptions only.
YOUR SUBSCRIPTION WILL CONTINUE AND AUTOMATICALLY RENEW AT MASTAPREP'S THEN-CURRENT PRICE FOR SUCH SUBSCRIPTION UNTIL TERMINATED IN ACCORDANCE WITH THE AGREEMENT. BY SUBSCRIBING, YOU AUTHORIZE MASTAPREP TO CHARGE THE PAYMENT METHOD DESIGNATED IN YOUR ACCOUNT AT THE START OF THE SUBSCRIPTION (OR, WHERE A FREE TRIAL APPLIES, WHEN THE FREE TRIAL ENDS), AND AGAIN AT THE BEGINNING OF ANY SUBSEQUENT SUBSCRIPTION PERIODS. WE SEND PURCHASE CONFIRMATION AND BILLING INFORMATION TO THE PAYER'S EMAIL, AND A RENEWAL REMINDER BEFORE AN ANNUAL RENEWAL. UPON RENEWAL OF YOUR SUBSCRIPTION, IF MASTAPREP DOES NOT RECEIVE PAYMENT, YOU AGREE THAT MASTAPREP MAY EITHER TERMINATE OR SUSPEND YOUR SUBSCRIPTION AFTER THE GRACE PERIOD SHOWN IN YOUR BILLING INFORMATION AND CONTINUE TO ATTEMPT TO CHARGE YOUR DESIGNATED PAYMENT METHOD UNTIL PAYMENT IS RECEIVED (UPON RECEIPT OF PAYMENT, YOUR ACCOUNT WILL BE ACTIVATED AND FOR PURPOSES OF AUTOMATIC RENEWAL, YOUR NEW SUBSCRIPTION COMMITMENT PERIOD WILL BEGIN AS OF THE DAY PAYMENT WAS RECEIVED).
You may manage or cancel your Subscription at any time by logging into your Account and following the online cancellation instructions in Settings → Plan and billing, or by contacting support. The cancellation process is straightforward, does not require contacting customer service, and may be completed entirely online. A parent payer can use the secure management link supplied with their receipt. Cancellation stops future renewals once submitted through the designated process and takes effect at the end of your current billing period. We provide confirmation of cancellation. If a provider problem prevents immediate completion, we will tell you and resolve it; you are not responsible for a renewal charge caused by our failure to act on a timely cancellation request. Deleting an Account is separate from cancelling renewal; when you request deletion, we also stop future renewal. Removing the browser, logging out or simply stopping practice does not cancel a Subscription.
If you cancel your Subscription, you may use your Subscription until the end of your then-current Subscription term; your Subscription will not be renewed after your then-current term expires. Cancelling during the Free Trial means no Fee is charged (Section 5.2). Otherwise, unless you exercise a right described in Section 5.9, you will not be eligible for a prorated refund of any portion of the Fee paid for the then-current Subscription period.
Fees are shown inclusive of, or together with, the applicable taxes disclosed before payment. Any withholding or other taxes imposed on payments of Fees to MastaPrep in your jurisdiction shall be your sole responsibility.
The Free Trial is the time to decide whether MastaPrep is for you: we do not offer discretionary change-of-mind refunds for the first charge, the current period or renewals. This does not affect mandatory withdrawal rights, remedies for defective or undelivered services, unauthorised or erroneous charges, or other rights that cannot lawfully be excluded. See our Refund and Cancellation Policy for the procedure. While MastaPrep has no obligation to issue discretionary refunds, if you experience any issues with the Services, you may contact us, and we will use commercially reasonable efforts to address your concerns and assist you.
To the extent permitted by applicable law, you agree to indemnify and hold MastaPrep (and its officers, employees, and agents) harmless, including costs and reasonable attorneys' fees, from any claim or demand made by any third party due to or arising out of (a) your breach of the Agreement, or (b) your violation of applicable laws or regulations. MastaPrep reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of MastaPrep. MastaPrep will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it. Nothing in this Section applies to a consumer beyond what applicable law allows.
The Services may contain links to third-party websites and services, and applications for third parties (collectively, "Third-Party Links and Applications"). Such Third-Party Links and Applications are not under the control of MastaPrep, and MastaPrep is not responsible for any Third-Party Links and Applications. MastaPrep provides access to these Third-Party Links and Applications only as a convenience to you, and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Links and Applications. You use all Third-Party Links and Applications at your own risk and should apply a suitable level of caution and discretion in doing so. When you click on any of the Third-Party Links and Applications, the applicable third-party's terms and policies apply, including the third-party's privacy and data gathering practices. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction in connection with such Third-Party Links and Applications. Check official sources for exam registration, dates, rules, accommodations and permitted tools.
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS, SUBJECT TO THE STATUTORY GUARANTEES AND CONSUMER PROTECTIONS THAT CANNOT LAWFULLY BE EXCLUDED. WE DO NOT GUARANTEE ADMISSION TO ANY EDUCATIONAL INSTITUTION, MAKE ANY WARRANTY REGARDING A SPECIFIC TEST SCORE OR SCORE IMPROVEMENT, OR ACCEPT LIABILITY FOR CLAIMS OF EDUCATIONAL MALPRACTICE OR SIMILAR ALLEGATIONS. OUR PRACTICE ESTIMATES, DIFFICULTY SETTINGS, LEARNING RECOMMENDATIONS AND TEST RESULTS ARE OUR OWN. THEY ARE NOT OFFICIAL SCORES, ADMISSION ADVICE OR A GUARANTEE OF A PARTICULAR RESULT. OUR QUESTIONS, SCORING, ADAPTIVE ROUTING AND PRACTICE TOOLS MAY DIFFER FROM THOSE USED BY AN EXAM PROVIDER. WE HAVE NO LIABILITY FOR EXAMINATION RESULTS IN CONNECTION WITH THE SERVICES. ANY CONTENT DOWNLOADED FROM OR OTHERWISE ACCESSED THROUGH THE SERVICES IS ACCESSED AT YOUR OWN RISK, AND YOU SHALL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY, INCLUDING, BUT NOT LIMITED TO, YOUR COMPUTER SYSTEM AND ANY DEVICE YOU USE TO ACCESS THE SERVICES, OR ANY OTHER LOSS THAT RESULTS FROM ACCESSING SUCH CONTENT. MASTAPREP AND OUR SUPPLIERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW. WE AND OUR SUPPLIERS MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR WILL BE ACCURATE, RELIABLE, COMPLETE, LEGAL, OR SAFE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. WE AIM TO PROVIDE THE SERVICES WITH REASONABLE CARE AND SKILL; IF YOU ENCOUNTER AN INCORRECT QUESTION, INACCESSIBLE PAID FEATURE, BILLING PROBLEM OR OTHER ISSUE, CONTACT SUPPORT OR USE THE RELEVANT REPORT CONTROL AND WE WILL INVESTIGATE AND PROVIDE REMEDIES REQUIRED BY LAW AND OUR PUBLISHED POLICIES.

SPECIFICALLY: (A) OUR PRACTICE QUESTIONS, ANSWER EXPLANATIONS, VOCABULARY MATERIAL, SKILL INTRODUCTIONS AND FULL-LENGTH PRACTICE TESTS ARE DRAFTED WITH AI TOOLS AGAINST THE PUBLISHED SKILL TAXONOMY OF THE RELEVANT EXAM AND ARE CHECKED BY EDITORIAL REVIEW BEFORE PUBLICATION. THEY ARE ORIGINAL MASTAPREP MATERIAL; THEY ARE NOT OFFICIAL EXAM QUESTIONS AND ARE NOT ENDORSED BY ANY EXAM PROVIDER. WHILE THE SERVICES ARE DESIGNED TO PROVIDE INFORMATIVE AND EDUCATIONAL CONTENT, THE RESULTS MAY BE IMPERFECT, INCOMPLETE, OR CONTAIN ERRORS. YOU ACKNOWLEDGE AND AGREE THAT OUTPUTS GENERATED BY ARTIFICIAL INTELLIGENCE ARE NOT GUARANTEED TO BE ACCURATE, CURRENT, OR SUITABLE FOR DECISION-MAKING PURPOSES. A PRACTICE ESTIMATE IS MASTAPREP'S OWN MEASURE; IT IS NOT AN OFFICIAL SCORE, A VALIDATED PREDICTION OR AN ADMISSION GUARANTEE. EVERY QUESTION CARRIES A REPORT CONTROL; MATERIAL THAT IS FLAGGED IS WITHDRAWN AND RE-CHECKED. YOU ARE SOLELY RESPONSIBLE FOR ANY DECISIONS MADE BASED ON THE OUTPUT PROVIDED BY THE SERVICES, AND, TO THE EXTENT PERMITTED BY LAW, MASTAPREP SHALL NOT BE LIABLE FOR ANY CONSEQUENCES ARISING FROM SUCH DECISIONS. OUR PRIVACY POLICY EXPLAINS WHICH INFORMATION IS SENT TO AI PROVIDERS AND CONFIRMS THAT YOUR PERSONAL INFORMATION IS NOT USED TO TRAIN AI MODELS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MASTAPREP OR OUR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOST DATA, COSTS OF PROCUREMENT OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE AGREEMENT OR YOUR USE OF, OR INABILITY TO USE, THE SERVICES OR ANY PART THEREOF, EVEN IF MASTAPREP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THE AGREEMENT (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION) WILL AT ALL TIMES BE LIMITED TO THE FEES PAID TO US BY YOU IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY. THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. YOU AGREE THAT OUR SUPPLIERS WILL HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THE AGREEMENT.
10.2 NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY OR CONSUMER PROTECTIONS THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING LIABILITY ARISING FROM FRAUD, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR OTHER NON-EXCLUDABLE CONDUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN MASTAPREP AND YOU.
Subject to this section, the Agreement will remain in full force and effect while you use the Services. We may suspend or terminate your rights to use the Services (including your Account) when reasonably necessary to protect users, investigate abuse, enforce the Agreement or comply with law. Where appropriate, we will explain the reason and provide a way to challenge the decision; urgent security or safeguarding action may precede notice. Upon termination of your rights under the Agreement, your Account and right to access and use the Services will terminate. Any refund consequences will be assessed fairly and subject to applicable law. Even after your rights under the Agreement are terminated, the following provisions of the Agreement will remain in effect: Sections 1.7, 1.8 and 4 – 14.
It is MastaPrep's policy to terminate membership privileges of any user who repeatedly infringes copyright, trademark, or other intellectual property rights upon prompt notification to MastaPrep by the respective intellectual property owner or their legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the Service in a way that constitutes intellectual property rights infringement, please provide us with the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright, trademark, or other intellectual property right; (ii) a description of the copyrighted work, trademark, or other intellectual property right that you claim has been infringed; (iii) a description of the location on the Service of the material that you claim is infringing; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright, trademark, or other intellectual property right owner, its agent or the law; and (vi) a statement by you that the above information in your notice is accurate and that you are the copyright, trademark, or other intellectual property right owner or authorized to act on the copyright, trademark, or other intellectual property right owner's behalf. If you have any questions, complaints or claims with respect to the Services, contact support@mastaprep.com with the issue and relevant account or payment reference. Please do not send passwords, full card details or identity documents by ordinary email. We will do our best to address your concerns. If you feel that your concerns have been addressed incompletely, we invite you to let us know for further investigation.

Nothing in the Agreement requires a consumer to give up a court, tribunal, regulator, complaint procedure or remedy that applicable law entitles them to use, including the consumer commissions established under the Consumer Protection Act 2019. You may contact us before escalating a complaint, but doing so is not a condition that removes your legal rights.
The Agreement, and your rights and obligations hereunder, may not be assigned, subcontracted, delegated or otherwise transferred by you without MastaPrep's prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. MastaPrep may assign the Agreement to a successor of its business on notice to you, subject to applicable law.
MastaPrep shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials, or failures of telecommunications or hosting providers.
These Terms and your use of the Services are governed by the laws of India, without regard to conflict of law provisions, subject to mandatory protections available to you under the law that applies to you. Subject to Section 13.3, the courts in India have jurisdiction over disputes arising from or relating to the Services or these Terms.
Where MastaPrep requires that you provide an email address, you are responsible for providing MastaPrep with your most current email address. In the event that the last email address you provided to MastaPrep is not valid, or for any reason is not capable of delivering to you any notices required or permitted by the Agreement, MastaPrep's dispatch of the email containing such notice will nonetheless constitute effective notice. You may give notice to MastaPrep by emailing support@mastaprep.com. Such notice will be deemed given when delivered to the email address listed above.
When changes are made, MastaPrep will make a new copy of the Terms available on the Site and any new Supplemental Terms will be made available from within, or through, the affected Services. We will also update the "Last Revised" date at the top of the Terms. If we make material changes to the Terms, we may (and, where required by law, will) also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via e-mail if you have an Account or another manner through the Services (which may include posting an announcement on the Site). If a change requires your agreement, we will request it. Changes do not remove rights or alter charges retrospectively for a purchase already made. If you do not agree to any change(s) after receiving notice of such change(s), you shall stop using the Services. Otherwise, your continued use of the Services constitutes your acceptance of such change(s). PLEASE REGULARLY CHECK THE SITE TO VIEW THE THEN-CURRENT TERMS.
The communications between you and MastaPrep use electronic means, whether you use the Services or send us emails, or whether MastaPrep posts notices on the Services or communicates with you via email. For contractual purposes, you (a) consent to receive communications from MastaPrep in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that MastaPrep provides to you electronically satisfy any legal requirement that such communications would satisfy if they were to be in a hardcopy writing. The foregoing does not affect your non-waivable rights. Optional marketing choices are separate from accepting these Terms; you may opt out of marketing without losing service access. We may still send necessary account, billing, security and legal notices.
Any waiver or failure to enforce any provision of the Agreement on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion.
If any portion of the Agreement is held invalid or unenforceable, that portion will be construed in a manner to reflect, as nearly as possible, the original intention of the parties, and the remaining portions will remain in full force and effect.
The Site and other parts of the Services can be accessed from countries around the world and may contain references to services and content that are not available in your country. These references do not imply that MastaPrep intends to announce such services or content in your country. The Services are controlled and offered by MastaPrep from India. MastaPrep makes no representations that the Services are appropriate or available for use in other locations. Those who access or use the Services from other countries do so at their own volition and are responsible for compliance with local law; the mandatory consumer and data-protection rights of your country continue to apply to you.

The Agreement is the final, complete and exclusive agreement of the parties with respect to the subject matter hereof and supersedes and merges all prior discussions between the parties with respect to such subject matter.
